Welcome to Yarn. These Terms of Service ("Terms") govern your access to and use of the Yarn website, applications, and services (collectively, the "Services"). Please read these Terms carefully before using the Services.

By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

1. Use of services

You agree to use the Services only for lawful purposes and in accordance with these Terms. You agree not to use the Services:

To engage in any conduct that restricts or inhibits anyone's use or enjoyment of the Services, or which, as determined by us, may harm Yarn or users of the Services or expose them to liability.

2. Communications consent

Our Services may allow you to send communications, including text messages (SMS), to your own customers. By using these features, you represent and warrant that you have obtained all necessary rights and consents from your customers to send such communications on their behalf, in compliance with all applicable laws and regulations, including the Australian Spam Act 2003. You acknowledge that under Australian law, consent may be inferred in certain circumstances, and you are responsible for ensuring such consent is validly established. You agree to indemnify Yarn against any claims arising from your failure to obtain proper consent.

3. Call recording

The Services may provide features that allow you to record or transcribe voice communications. You are solely responsible for complying with all applicable laws in the relevant jurisdictions when using these features. This includes, but is not limited to, obtaining consent from all parties to the communication before recording or transcribing, in line with Australian regulations. Yarn has no responsibility or liability for your failure to comply with these obligations. You agree to indemnify Yarn from any and all claims, damages, liabilities, costs, and fees (including reasonable legal fees) arising from your use of the recording and transcription features in violation of applicable laws.

4. Intellectual property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Yarn, its licensors, or other providers of such material and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

5. Disclaimer of warranties

The Services are provided on an "AS IS" and "AS AVAILABLE" basis. Yarn makes no representations or warranties of any kind, express or implied, as to the operation of the Services or the information, content, materials, or products included on the Services.

6. Limitation of liability

In no event will Yarn, its affiliates, or their licensors, service providers, employees, agents, officers, or directors be liable for damages of any kind, under any legal theory, arising out of or in connection with your use, or inability to use, the Services. To the maximum extent permitted by Australian law, our total liability for any claim is limited to the fees you have paid in the three months preceding the claim.

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. We will provide notice of any changes by posting the new Terms on this page.
